The Tamale High Court has ordered a rerun of the Kpandai parliamentary election, ruling that a fresh poll must be conducted within 30 days.
The decision, delivered by His Lordship Emmanuel Brew Plange, comes after a legal challenge to the outcome of the 2024 parliamentary election in the constituency. The petition alleged widespread irregularities during voting and collation, which the petitioner argued compromised the credibility of the final results.
The suit was filed by Daniel Nsala Wakpal, former Member of Parliament and NDC Parliamentary Candidate for Kpandai. He contested the election of Matthew Nyindam as MP, insisting that the December 7 parliamentary poll was invalid.
According to Mr. Wakpal, the election was fraught with irregularities and inconsistencies captured on FORM 8A (Statement of Poll and Declaration of Results for Parliamentary Elections, also known as the Pink Sheet). He claimed that 41 out of the 152 polling stations showed discrepancies that violated the requirements of Regulations 32(7) and 39(2) of C.I. 127, which govern the conduct of public elections in Ghana.
He argued that these irregularities undermined the integrity of the process, stating:
“The parliamentary election held in the Kpandai constituency on 7th December 2024 was not conducted in compliance with Regulations 39 of the Public Elections Regulations, 2020 (C.I. 127).”
